Purpose

These terms of use (the “Terms”) govern access to and use of the MaCompta application by any user. Creating an account or using the application in any way implies full and complete acceptance of these Terms.

Description of the service

MaCompta is a personal and household budgeting tool which makes it possible, among other things, to track accounts (current accounts, savings, loans...), record transactions and transfers, and set budgets by category, recurring expenses and savings goals, alone or with several people in the same household.

Access to the service and account creation

Creating an account requires an active subscription linked to the email address used, or an ongoing business subscription. Each account created in this way opens a separate set of accounts, of which the holder is the owner; the owner can then invite other users (editor or read-only roles) to access it. The accounts of different holders are strictly separated from one another.

The email address associated with an account must be confirmed by its holder. A confirmation link is sent to the address provided; until it is confirmed, logging in by email is not available.

Prices, payment and invoicing

The seller is GL Digital (Lusty Goset), Rue Ivienne 29, 6511 Strée, Belgium — company number 1041.371.313. Payments are processed by Stripe Payments Europe; no bank card data passes through MaCompta or is stored there.

The prices shown on the website are the prices actually paid. The publisher is under the small business VAT exemption scheme (Article 56bis of the Belgian VAT Code): no VAT is applied or invoiced, and the invoices issued carry a statement to that effect.

A buyer acting for the purposes of their business can request an invoice in the name of their company at the time of purchase, by ticking the box provided and entering the legal information requested (company name, VAT number, registered office address). The invoice is then issued separately and sent electronically — as a structured invoice (Peppol network) when the customer is a VAT-registered business established in Belgium.

User obligations

The user undertakes to:

• provide accurate information when creating their account;
• keep their username and password confidential;
• use the application for personal or household purposes, in compliance with the laws in force;
• not attempt to circumvent security measures or to access data that does not belong to them.

The user is solely responsible for the accuracy of the financial data they enter in the application. The publisher cannot be held liable for decisions taken on the basis of the information displayed.

Intellectual property

The application, its source code and its visual identity remain the exclusive property of the publisher, under the conditions described in the Legal notice.

Tax estimates

MaCompta offers tax estimation tools: a tax simulation in the business space, and a review of expenses that qualify for a tax reduction in the personal space. They are provided for information and educational purposes, to help the user understand how their tax return is built up.

They constitute neither tax advice nor legal advice, nor any service reserved for regulated professions. The results shown are non-binding estimates, calculated from the parameters of a given income year and solely from the information entered or recorded by the user. They do not replace an accountant, a tax adviser, the official simulator of the FPS Finance (SPF Finances), or the tax assessment notice.

The scope covered is deliberately limited, and stated on every screen: Belgium only and, for the business simulation, a self-employed person trading as a natural person in their main occupation. Scales, rates and ceilings change every year; the income year used is shown with each result, and values that could not be cross-checked are flagged as such.

The user remains solely responsible for the content of their tax returns. The publisher cannot be held liable for any difference between an estimate shown and the tax actually due, nor for the consequences of a return prepared solely on the basis of these tools.

Availability of the service

MaCompta is an application under active development: interruptions, changes to features or maintenance may occur without notice. The publisher endeavours to ensure continuous availability, without any obligation of result.

Termination and account deletion

The user can at any time reset their budget data or request the complete deletion of their account, as described in the Privacy policy. The publisher reserves the right to suspend or terminate an account in the event of use that does not comply with these Terms.

An account without an ongoing subscription that has remained inactive for 65 consecutive days is deleted, along with the data it contains, after two warning emails have been sent to the account's address (on the 55^th and 60^th days). Logging in is enough to keep the account. An ongoing subscription prevents this deletion however long the inactivity, and gives no right to a refund of the period already paid.

Right of withdrawal

Under Book VI of the Belgian Code of Economic Law, every consumer in principle has a period of 14 days to withdraw from a distance purchase, without having to give any reason.

This period does not apply, however, where performance of the service has begun, with the consumer's prior express consent, before the end of the withdrawal period, and the consumer has acknowledged that they will lose their right of withdrawal once the service has been fully performed (Article VI.53, 13° of the Code of Economic Law). This is the case for the MaCompta subscription: access is opened immediately after payment, on the email address used to pay, which fully performs the service from that moment. Before completing a purchase, the user must therefore tick a box expressly confirming:

• that they request performance of the subscription to begin immediately upon payment, and
• that they acknowledge they will consequently lose their right of withdrawal once their access is opened.

A user who wishes to keep their 14-day right of withdrawal rather than obtain immediate access can contact support@macompta.app before paying.

Model withdrawal form

You do not have to use it: a simple message to support@macompta.app is enough. It is reproduced here because the law requires it to be made available to you.

Legal guarantee of conformity

The service must match its description. In the event of a lack of conformity, you can ask for it to be brought into conformity, and then for a price reduction or termination of the contract if this does not happen within a reasonable time, under the conditions of Book VI of the Code of Economic Law. This guarantee is independent of the right of withdrawal: having waived that right to obtain immediate access does not deprive you of it.

Complaints and dispute resolution

Write to us first at support@macompta.app: most situations are resolved in a single message. Failing agreement, you can refer the matter free of charge to the Consumer Mediation Service (a Belgian federal public service). The European Commission also provides an information page on consumer redress: consumer-redress.ec.europa.eu.

Changes to the Terms

The publisher may change these Terms at any time, in particular to take account of changes to the application or to the regulations. The date of the last update is shown at the top of this page.

Governing law and jurisdiction

These Terms are governed by Belgian law.

In the event of a dispute, the user and the publisher will endeavour to find an amicable solution. Failing agreement, and without prejudice to the mandatory provisions protecting consumers (which allow them in particular to bring proceedings before the court of their own place of residence), any dispute falls within the jurisdiction of the Court of First Instance of Hainaut, Charleroi division (Tribunal de première instance du Hainaut, division de Charleroi — Avenue Général Michel 2, boîte 1, 6000 Charleroi).
